If the earlier disposition of the case had been on the merits and in a manner known to the law, the second complaint on "almost similar evidence" presented in the first complaint would not be admissible.

The Supreme Court judges, Justice UU Lalit & Justice Vineet Saran held that a second complaint on the same grounds as the first complaint could not be upheld.
