Why there is no CBI investigation on Bhopal Jail-break encounter case, SC asks MP Govt. and Center[Read Petition]

Under the pressure of a special leave petition filed by Mehmooda Mohammed Salim Mucchhale through Advocate Sidharth Dave, SC has issued a notice against the Center, the State, and the Central Bureau of Investigation for not initiating a thorough investigation into the alleged encounter of eight Students Islamic Movements of India activists following a daring prison break in Bhopal.

The objective of filling petition is to challenge the Judgment passed by Madhya Pradesh High Court in Feb, this year and get the detailed explanation of why the CBI investigation was not ordered in the case. The Bench headed by the justice Ranjan Gogoi, has asked the Madhya Pradesh State Government and the Center to present an explanation on the matter.

The petitioner is posturing 13 suspicious questions on the credibility of the current mode of investigation, pointing out the “rapidity” in forwarding investigation by the IPS Officer and appointment of a Commission of a retired high court judge under the commissions of Inquiry Act, 1952.

Furthermore, the petition also underlines the fact that the Madhya Pradesh CM had publicly announced rewards for the police officials who carried out the encounter and condemned the deceased under-trial convicts, marking them as terrorists.

The high Court had formerly, rejected the plea of one of the deceased mother when she asked for certain documents of inquiry into the incident. The court declined the request by saying that “the family members of the deceased family has no part in such documents as they are alien for such aspects of the inquiry”

Calling the inquiry a “fraud”, the petitioner demands investigation into the incident by the CBI or a SIT formed by the court.
