Urgent Hearing was declined by SC regarding PIL against Centre's Order on Monitoring of Computers, 2019

Today, the Supreme Court Bench led Chief Justice of India Ranjan Gogoi declined urgent hearing of Advocate Manohar Lal Sharma's PIL by challenging Central Government's order authorizing ten central agencies to obstruct, detect and decrypt information on computers of any citizen.

SC mentioned that it will hear petitioner M L Sharma only after the receipt of recompense cost of Rs.50, 000.00 is shown to the court trust on him earlier.

The bench comprising Justice S K Kaul stated that it will hear his plea after M L Sharma paid the cost of Rs 50,000 imposed on him last month for filing a PIL against Finance Minister, Arun Jaitley.

Stated by M L Sharma to the bench while answering the court’s query that “ I have deposited the amount”. In return CJI said that if you have deposited, show the receipt to the Registry and let the matter be registered in the court.

The notification issued by Home Ministry under Section 69 of the IT Act was challenged by the PIL. Where in PIL, M L Sharma has alleged the objective behind the notification. The intention was to sway the whole country through dictatorship and win the coming general election under an undisclosed Emergency. He specifically alleged that the present government is trying to implicate innocent citizens. Which was on the basis of the information collected by these agencies?

The government's powers to investigate on citizens without recording an FIR for any cognizable offence, and to thread its citizens to slavery was interrogated by M L Sharma. Apart from the Delhi police commissioner, the agencies authorized to investigate are the Intelligence Bureau, Narcotics Control Bureau, Enforcement Directorate, Central Board of Direct Taxes, Directorate of Revenue Intelligence, Central Bureau of Investigation, National Investigation Agency, Cabinet Secretariat and the Directorate of Signal Intelligence.
