Union Cabinet brings ordinance: Child rape to attract capital punishment provisions

New Delhi: Intense public outrage over recent rapes in different parts of the country, has led Centre to bring in an Ordinance making Child rape an offence which will attract death penalty for those convicted of raping children up to 12 years of age.

The ordinance seeks to suitably amend the legal provisions in Indian Penal Code (IPC), the Evidence Act, the Code of Criminal Procedure (CrPC) and the Protection of Children from Sexual Offences (POCSO) Act to make child rape a capital offence. The ordinance also increases punishment of those convicted of rape of women from rigorous imprisonment of 7 years to 10 years, extendable to life imprisonment. In case of rape of a girl under 16 years, minimum punishment has been increased from 10 years to 20 years, extendable to imprisonment for life. Further ordinance also provides for investigation to be completed in 2 months. Trials to be done in 2 months and appeals to be disposed off in six months,

In addition NCRB is to keep database of sexual offenders nationally and no bail to be provided to a person accused of raping a girl under the age of 16.

The ordinance has received President's ascent.
