Supreme Court hearing Punjab ’s plea seeking vacation of stay passed by Punjab and Haryana High Court in all criminal matters against former Punjab GDP Sumedh Singh Saini

AG Patwalia: Its an unprecedented order, they have given blanket stay

CJI: Yes,they cant pass this order

Rohatgi: The State has not followed a single order. He has survived an assassination attempt.

CJI: It is shocking. We have never seen an order like this.

List after 4 weeks.

Rohatgi: Let the HC dispose off this writ , the whole thing will come to an end

CJI: We will ask the HC to dispose off this matter before another bench in 2 weeks.

COURT:

We think it fit to requests to direct the CJ of Punjab and Haryana HC to place it before another judge and dispose it in 2 weeks

Court is informed of a blanket protection granted by High Court to a former Punjab DGP

CJI Raman: This is an unprecedented order, such kind of order we don’t encourage. What is this order? Protection in Future cases also? This is shocking

Adv General for Punjab DS Patwalia: There’s Blanket stay, protection against everything, HC has relied on earlier order in Habeas corpus matter.

Sr Adv Rohatgi: I appear on caveat, there’s 3.5 years delay. This officer was DGP in the State.

CJI Ramana: Whatever it may be, you can’t pass an order saying future cases also he can’t be arrested? What is this.
