Supreme Court Directs Centre To Issue Instructions To Implement Reservation In Promotions For Persons With Disabilities Within 4 Months

The Supreme Court on Tuesday (28th September 2021) directed the Central Govt. to issue instructions to implement the reservation in promotions for persons with disabilities at the earliest and not later than 4 months. The Central Government sought clarity on its decision declaring that persons with disabilities have the right to reservation in promotions.

Respondent's counsel, Advocate Rajan Rani, asserted that 5 years have passed since the enactment of the Right of Persons with Disabilities Act, 2016, and no instructions have been given.

In light of certain clarifications which are necessary, Additional Solicitor General Madhavi Divan has stated that the directions that are to be issued as per proviso to Section 34 of the Right of Persons with Disabilities Act, 2016 could not be issued. She has also stated that the clarifications are required so that the instructions issued by the Central Government do not become susceptible.

As a result, the Supreme Court dismissed the miscellaneous application and ordered the Central Government to issue instructions within four months of the order's date.
