A vacation bench of Justices AK Goel and Ashok Bhushan, on Thursday, modified a Delhi HC order by stopping Janata Dal (United) president and rebel MP Sharad Yadav to withdraw his salary and perks. The apex court, however, allowed Yadav to stay in his official bungalow till the pendency of the plea.

The top court’s decision came on a petition, filed by JD (U)’s Rajya Sabha MP Ramchandra Prasad Singh, challenging the Delhi HC’s interim order passed on December 15 last year.

In its order, the Delhi HC had refused to grant an interim stay on Yadav’s disqualification as a Rajya Sabha MP. The court further allowed Yadav to draw his salary and perks besides allowing him to retain his official residence.

The court agreed to hear Singh’s appeal on May 18 and issued a notice to Yadav regarding the same.

Ramchandra Prasad Singh had demanded the disqualification of JD(U) MPs Yadav and Ali Anwar on the grounds that they had violated the party’s directives by attending a rally of opposition parties in Patna.
