SC says no coercive action to be taken against 40 lakh people left out of Assam NRC draft

The Supreme Court on Tuesday directed the authorities that no coercive step will be taken against the 40 lakh people who have failed to make it to the Assam’s National Register of Citizens (NRC) list published on July 30.

The apex court passed the directions after hearing, Attorney General KK Venugopal, NRC co-ordinator for Assam, Prateek Hajela, and Additional Solicitor General Tushar Mehta, representing Assam.

The bench ordered the Centre, in consultation with NRC co-ordinator for Assam Prateek Hajela, to set up a “fair and equitable” standard operating procedure (SOP) to adjudicate claims and objections of those who did not find their names in the draft NRC.

The Attorney General informed the court that the concerned ministry is in the process of preparing modalities of the SOP, so as to “deal with the different dimensions of the exercise of hearing the claims and objections of those excluded from draft NRC in a fair manner.”

Mr. Venugopal informed the bench that the SOP would be placed before the court by mid-August.

The bench then said that it would prefer to refrain from commenting on the draft NRC and would wait for the government to submit its SOP for vetting.

The matter has now been listed for hearing on August 16.
