SC refers Female Genital Mutilation case to five-judge constitution bench

A three-judge Bench of the Supreme Court of CJI Dipak Misra, Justices A.M. Khanwilkar and D.Y. Chandrachud today referred to a five-judge constitution bench a plea challenging the practice of Female Genital Mutilation (FGM).

The SC’s bench decision came after a request to that effect was made by the Attorney General of India KK Venugopal, and Senior Advocate Mukul Rohatgi representing the Dawoodi Bohra community.

I am of the opinion that this matter should be referred to Constitution Bench”, Venugopal has said.

The petitioners, however, opposed the request, saying that each and every request, not necessarily be referred to the constitution bench.

At this point, advocate Rohatgi submitted before the Bench:

This is not a question of every case. This is a very important case.

The Bench then agreed to the request and referred the matter to Constitution Bench.
