SC extends relief to Karti Chidambaram from arrest by ED till March 26

New Delhi: The Enforcement Directorate plea for vacating of stay from arrest of Karti Chidambram in INX case granted by HC, was rejected by the Supreme Court bench led by Chief Justice Dipak Misra. The court has given stay till March 26, the next date of hearing.

Earlier Delhi High  had extended interim protection from arrest  by Enforcement Directorate  to Karti Chidambaram in the INX Media money laundering case.

The SC also transferred to itself all the matters pending before the Delhi HC relating to the power of Enforcement Directorate (ED) to arrest in money-laundering cases and also a plea filed by Karti seeking protection from arrest in ED case.There are conflicting interpretations given by High Courts in relation to  power of ED to arrest and SC will decide on the matter. The top court would answer the question regarding the interpretation of section 19 of the PMLA (Prevention of Money Laundering Act).The ED counsel maintained that High Court had the power to arrest in such case and if interpretation other than this was made,this will be misused by people like Nirav Modi.

Karti is accused of receiving bribe in 2007 for allegedly facilitating foreign investment worth Rs Rs 305 crore for INX Media, owned by Peter and Indrani Mukherjea , during the period his father P Chidambram was the Finance Minister.
