SC dismisses plea challenging pensionary and other benefits to former MP's

New Delhi : The SC bench comprising Justice J Chelameswar and Sanjay Kishan Kaul dismissed a PIL filed by NGO Lok Prahari asking for stoppage of pension and travel allowances to former MP's.

The NGO approached SC as its similar PIL had earlier been dismissed by Allahabad High court. It claimed pension and other benefits being given to former MP's is contrary to aricle 14 (Right to Equality) of the constitution. The PIL also stated that Parliament has no authority to provide pensionary benefits to MP's without making a law.

Though the SC had admitted the PIL but on March 7, the bench said it is reserving its order. Centre then had  told the apex court that the entitlement of former MPs to get pension and other benefits was "justified" as their dignity has to be maintained even after they completed their term. The top court had asked the Centre to devise a mechanism by which salaries of MP's could be decided.

The Centre had told the bench that in Finance Bill 2018   provisions have been made regarding salary and pension of MPs .Further it provides for fair revision of their allowances after every five years starting from April 1, 2023, on the basis of cost inflation index.

The top court had in March last year agreed to examine the constitutional validity of laws granting pension and other perks to retired MPs and had sought responses from the Centre and ECI on the issue.
