SC declines bail to BRD Medical College Principal in the Gorakhpur infant's death case

On Wednesday, the Supreme Court declined interim bail to Dr Rajeev Kumar Mishra, former principal of BRD medical college and hospital in Gorakhpur, in connection with the death of 60 children at the hospital.

The case was heard by a two-judge bench comprising of Justices L Nageswara Rao and MM Shantanagoudar.

In his defense, Dr Mishra told the SC bench that the children had died of Japanese Encephalitis and not due to oxygen shortage, as alleged by the state government.

During the course of proceeding, advocate Mukul Rohatgi, representing the appellant argued that Mishra was arrested on August 29, 2017, and has spent over 10 months in the jail. He further said that, “Chargesheet has been filed in the case. The co-accused in the case, including Dr Kafeel Khan, who was the head of the encephalitis ward, and oxygen supplier Manish Bhandari, have already got bail. Mishra should be granted at least interim bail till the petition is disposed of”.

When Rohatgi was asked about the charges against Mishra by the SC bench, the senior lawyer said his client had been blamed for not paying the bills to the oxygen supplier, as a result of which the supply was allegedly disconnected.

In response to Rohatgi statement, the judges said, “Then, what do you expect? That you will not clear the bills and the vendor will keep supplying the gas?”

The court has issued a notice to the UP government on Mishra’s plea and listed the matter for further hearing on June 6.
