SC Collegium sends back names recommended by Patna High Court for judgeship

The SC Collegium has disapproved the Patna HC’s recommendation to elevate five names as High Court Judges.

The names of one judicial officer and four lawyers, including Bidu Bhusan Pathak, Sunil Kumar Mandal, Anand Kumar Ojha, Mohammad Nadim Seraj and Nivedita Nirvikar were recommended for the judgeship by the then Chief Justice of the Patna HC, Rajendra Menon in January. 

Among the recommended names, Bidu Bhusan Pathak is the registrar of the Patna HC while Mandal, Ojha and Seraj are Maharashtra government counsel. And, Nirvikar is serving as a central government counsel at the High Court.

Following the recommendations, the Collegium had called all five persons for interaction. And, the Collegium took the decision to send back the recommendations on account of interaction and materials, which included observations, made by the department of justice.

Initially, six names were recommended for elevation to the SC Collegium. The name of Surendra Prasad Sharma was recommended as the sixth name, by the then law department society. However, Sharma died following brain haemorrhage.
