Rajasthan High Court Grants Bail to Accused on the Payment of GST Evasion Amount

NEW DELHI: The Rajasthan High Court recently granted bail to a man accused of GST evasion after observing that he had paid the amount.

The accused was arrested for offences punishable under Section 132(1) of the Rajasthan Good and Services Tax Act of 2017.The accused contended that he was falsely implicated in the case. The alleged tax evasion amount, i.e., 43.9 crores has already been deposited.

 The accused's counsel also stated that the accused has been imprisoned since November 8, 2022, and that the alleged offence is punishable by a maximum sentence of five years and the GST Department, on the other hand, contended that simply depositing the GST evasion amount proves that the accused evaded GST, and because economic offences are in a class of their own, bail should not be given to the accused..

The court without making any observations gave no opinion on the merits of the case, opined that the accused deserved bail.. Thus, the court, granted bail to the accused on a personal bond of Rs. 1,00,000  with two sureties of Rs 50,000 each, with the condition that the accused cannot travel abroad without the permission of the court.
