People can File Income Tax Returns without Aadhaar, Says Delhi HC, At least Till March 31, 2019

People can now file their income tax returns online without the mandatory linking of PAN to Aadhaar, as the Delhi High Court has asked the Central Bureau of Direct Taxes (CBDT) to create a platform for filing returns sans Aadhaar, at least till March 31, 2019.

The court’s decision came while acting on a plea filed by one Shreya sen and another petitioner. In their plea, the petitioners had sought court’s directions for permission to file the Income Tax Return for the assessment year 2017-2018 without adhering to the condition of providing the Aadhaar Card Registration/Enrolment Number.

The petitioners had also sought to issue directions to CBDT to respond to its notification dated June 30, 2018, saying that despite the CBDT’s notification informing people about the extended deadline for the PAN-Aadhaar linking many emails are being received in cases like theirs.

A bench of Justices S Ravindra Bhatt and A K Chawla then ordered,

It is of the opinion that at least for the period till March 31, 2019, the CBDT shall issue an appropriate direction, and also create a platform by amending a digital form, substituting them properly to enable “opt out” from the mandatory requirement of having to furnish the Aadhaar registration or Aadhaar linkage, for the duration. The exemption subsists i.e. till 31-03-2019.”
