Odisha Court Sentences Maoist Leader Sabyasachi Panda To Life Imprisonment For 'Conspiring To Wage War Against Government of India'

The District and Sessions Court in Odisha has convicted and sentenced Maoist leader Sabyasachi Panda to imprisonment for life. Panda was found liable for 'making conspiracy to wage war against the Government and also abetting others to wage war against the Govt. of India by using criminal strength.' The Maoist leader was arrested by the police on July 18, 2014 by a team of police led by Anirudha Singh (SP) and is in jail from then.

To sentence life imprisonment, the court in regarded all the submission of the prosecution, where the accused was organizing the Maoist activities inside as well as outside the State and caused death of many innocent people and his involvement is established in many other cases. And the offences under Sub-Sec.121/121-A of IPC are clearly established against the accused.

The court, however, also stated that starting from the registration of the case until its submission of the charge sheet the entire procedure has been done by the senior officers in a very casual manner and trial of the case has been conducted by the prosecution in a very casual and unsystematic manner.

The Court also by holding him not guilty for the offence punishable under Sec.124 of the IPC, the court stated that there is absolutely no evidence available against the accused to establish that he had assaulted or used criminal force to the President, Governor, etc. with intends to compel or restrain the exercise of any lawful power.
