No substantive Arguments and response to Evidence by India: Qureshi submits on final day of Jadhav’s Case Hearing

Pakistan submitted its closing arguments to the International Court of Justice on the fourth day of hearing of Kulbhushan Jadhav's case.

From the side of Pakistan, Khawar Qureshi said that the arguments submitted by India are not substantive nor they were accompanied by anything which would be a solid response to the evidence given by Pakistan which showed that Jadhav is a spy and he acted as per the plan of National Security Advisor Ajith Doval.

He also submitted that the 2008 bilateral treaty between India and Pakistan provided that consular access will be completely excluded when the matter relates to espionage and terrorism.

He asserted on the following points

1.      Military courts follow the same rules of procedure and evidence as civilian courts. Jadhav's confession was recorded as per Section 164 of the Code of Criminal Procedure by a Magistrate, who was called as a witness in the trial, said the Pakistani counsel.

2.      Right to fair trial is an absolute right under Pakistani Constitution.

3.      Jadhav himself has not sought for any review. He was afforded right to fair trial, and was given legal assistance

India was blamed by Qureshi as a human rights violator. He took examples of the Kathua rape case, the Gujarat riots, Samjautha express blast case etc.

While concluding, he he prayed for rejection of relief to India and said the following:

"When we talk of the unfortunate incident of Pulwama... India has become the judge and executioner and call themselves the victim without any evidence... Pakistan has the right to ask for proof.”
