Muslim man files petition in Kerala HC seeking release of Hindu wife from father’s custody

Fasil Mahmood, a 27-year old man from Kerala's Kozhikode district filed a Habeas Corpus petition in the Kerala HC seeking to free his Hindu wife from the illegal custody of her father.

Mahmood, in his petition, submitted that he was involved in the hotel business in Bengaluru and during that time he fell in love with the woman in his neighbourhood.

He further said that following two years of courtship, the woman had converted to Islam. The two then got married as per Muslim customs and started living in Kozhikode.

However, Kozhikode police forced him and his wife to sign on blank stamp papers at the intervention of the woman’s father and other relatives. He was later handed over to Bengaluru police, Mahmood alleged.

Following this, Bengaluru police sent the woman back with her father.

He even alleged that he was subjected to physical and mental torture by the Bengaluru police.

The petitioner further alleged on May 29 he received a threatening phone call from someone telling him that he will be killed if he did not give up on his wife. The petitioner claimed he received similar threats yet again on June 5.

However, when Mahmood came to know about his wife’s pregnancy and that “her life and future were in danger”, he submitted the petition seeking the court’s intervention.

The petition came up for hearing before a bench of Justices V Chitambresh and KP Jyothindranath, who ordered notice to the woman’s father residing in Bengaluru.
