MP HC set to hear plea against life imprisonment awarded by the Trial Court[Read Order]

Man delayed 277 days in filing the petition against the Judgment of conviction passed by the Trial Court wherein he was sentenced to life imprisonment in a murder case. The Madhya Pradesh High Court accepted an application filed by the accused for condonation of delay in filing the petition against the Trial Court’s decision.

A division bench comprising Justices SK Gangele and Rajeev Kumar Dubey, declared that the appeal is filed against the judgment of conviction and the Trial Court has already sentenced him life imprisonment and now the delay in filing the petition is condoned.

The Limitation period to file a petition is very short, due to the reason Section 5 of the Limitation Act deals with the condonation of delay in case of appeal and a delay of 277 days is quite long enough to dismiss the petition. This section is introduced to meet the end of justice. 

Advocate D. K. Shrivastava appeared for the appellant and Government Advocate Bhrahmdutt Singh represented the respondent.

The appellant requested the re-evaluation of the conviction given by the Trial Court against him.

The Court later asked for the case documents from the Trial Court to further the proceedings.
