SC to hear Centre's Petition Against Delhi HC Verdict on Hanging of Nirbhaya Case Convicts on Feb 11

 

 Hon’ble Supreme Court to hear the Center's appeal on February 11 challenging the judgment of the Delhi High Court that had rejected its petition against the stay on the execution of the four convicts(Mukesh, Akshay, Pawan and Vinay) of the Nirbhaya gang rape and murder case.

A bench headed by Justice R Bhanumathi failed to heed Solicitor General Tushar Mehta's request to give notice on the Centre's appeal to the four convicts, saying it would postpone the matter further.

The bench, which also includes Justices Ashok Bhushan and A S Bopanna, informed General Mehta that on February 11 it would hear him, and it could consider whether notice was needed to be given to the convicts.

At the outset, General Mehta told the court that in the case, "nation's patience is being tested" and the bench will have to pass a law on the matter.

Akshay Kumar and Vinay Kumar Sharma's petitions for mercy have already been rejected, he said, adding that the fourth prisoner Pawan Gupta has not filed a curative petition, nor a plea for mercy. "The question is, is the authority required to wait endlessly?" asked General Mehta.

The bench replied, "No one can be compelled to take remedies."

General Mehta said that there may be a situation in this case where one prisoner "sits tight for five years" and the others then petition the supreme court trying to commute the death penalty on the grounds of delay in execution. "The high court has granted them (convicts) one week time to avail all their remedies. This amply protects you," the bench said.

General Mehta said the bench will have to interpret the law as to whether or not the convicts can be hanged separately in the same event. He asked the court to give notice to the four death row convicts when the bench said it would hear the case on February 11th.
