Kathua gang rape trial stayed till May 7 by SC

New Delhi: In the midst of pleas and counter pleas for shifting or not shifting the trial of Kathua Gang Rape trial, the Supreme Court bench of Chief Justice Dipak Misra and Justices D Y Chandrachud and Indu Malhotra stayed the trial till May 7 in the Kathua gang rape and murder case. The father of the victim had filed a petition in SC asking for shifting of trial from a local court in Jammu to a court in Chandigarh where as two of the accused had filed a case asking for trial to be held in Jammu and case be handed over to CBI.

A minor girl child from a minority nomadic community had disappeared from near her home in a village near Kathua in Jammu region on January 10. Her body was found in the same area a week later. It is alleged that girl was kidnapped, drugged and raped inside a place of worship before being killed. The state police's Crime Branch, which is probing the case, filed the main charge sheet against seven persons and a separate charge sheet against a juvenile in a court in Kathua district last week.

The eight year girl's father approached the SC, saying there is threat to their family, friend and the lawyer fighting the case.

The SC warned that court would not hesitate to shift the trial if there was slightest risk of lack of fair trial and there real concern is to hold proper prosecution.

The next hearing on the matter will be held on May 7.
