Justice KM Joseph Elevation Uncertain Following the Superannuation of Justice Chelameswar

The process of Uttarakhand High Court Chief Justice (CJ) KM Joseph’s elevation as a Supreme Court judge might possibly get delayed following the superannuation of Justice Jasti Chelameswar due today.

The top court collegium had on May 11 agreed in-principle to reiterate Justice Joseph’s name as a judge of the SC to the Centre. However, the collegium failed to decide the date for pressing for his name to the Centre.

Further, in its next meeting on May 16, the collegium deferred the decision saying, “... There should be further deliberation and broad-based consideration of the names of the chief justices as well as judges of the high courts which are at present not represented in the Supreme Court.”

Now with Justice Chelameswar demitting the office today, Justice A K Sikri, who is sixth senior-most judge in the Supreme Court, will become part of the five-member collegium. And this will necessitate the need of reconsideration about the collegium’s earlier decision to reiterate Justice Joseph’s name back to the Centre.
