IT case: Top court denies relief to Hospitality firm linked to Robert Vadra

New Delhi: A SC bench of Justices A.K. Sikri and Ashok Bhushan dismissed the Special Leave Petition (SLP) filed by Sky Light Hospitality LLP, linked to Robert Vadra  which had challenged an income-tax (I-T) department notice to it for re-assessment of its profits from land deals in Haryana and Rajasthan for 2010-11.Earlier the High Court had also dismissed the petition.

The case relates to Rs 35 crore income for 2010-11 which the IT department suspects had escaped its assessment. The company which was earlier a private limited firm and has now been turned into Limited Liability Partnership (LLP) firm , contested the reassessment as done by IT department. It is alleged Sky Light Hospitality took a loan of Rs 5 crore from DLF to purchase a plot and later the same plot was sold to DLF for Rs 50 crore.

The counsel appearing for the Sky Light Hospitality took a plea in the court that notice was served to Sky Light Hospitality Pvt Ltd, a company that did not exist and since it has not been served to them,it has no bearing for them. This was contested by ASG appearing for IT department and said the period for which the IT notice has been sent, the company's name was Sky Light Hospitality Pvt Ltd only.

The SC bench did not agree with the petitioner's lawyer contention and dismissed the appeal.
