Govt to file review petition in Supreme Court against SC/ST Act ruling

New Delhi: With pressure mounting on Centre from its allies and its own ruling party, the centre on Monday decided to file a review petition against the Supreme Court’s order on the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Supreme court in its recent ruling had put an end to immediate arrests in complaints filed under the SC/ST Act provisions.

 Union Law Minister Ravi Shankar Prasad had recently stated that the Law Ministry has given an opinion in favour of filing a review petition. The National Commission for Scheduled Tribes (NCST) and the National Commission for Scheduled Castes (NCSC) have also conveyed their views and demanded a review of the verdict, saying the original Act, as it existed before the SC verdict, should be restored.

The Scheduled Castes (SCs) and the Scheduled Tribes (STs) Prevention of Atrocities (PoA) Act, 1989 was amended as recently in January 2016 and it included new offences to ensure speedy justice to victims.

Social Justice and Empowerment Ministry will file the petition on behalf of the government. Meanwhile a nationwide bandh was called to protest against Supreme Court order on stopping of arrest under SC/ST act. The bandh has led to widespread violence across North Indian states. The Punjab Government has cancelled the class 10th and 12th CBSE examination slated on Monday.
