Federal judges dismisses 'serious' misconduct claims against Justice Brett Kavanaugh

A federal panel of judges reviewing 83 complaints against Supreme Court Justice Brett M. Kavanaugh has dismissed all the claims, arising largely from statements Kavanaugh made during his confirmation hearings.

In a 10-page order from the Judicial Council of a Denver-based US appeals court, the complaints alleged Kavanaugh of making false statements during his Senate confirmation hearings in September, voicing inappropriate partisan statements, displaying a lack of judicial temperament, and treating Senate Judiciary Committee members with disrespect.

The judicial council of a Denver-based US appeals court in its order has said the allegations contained in the complaints against Justice Kavanaugh are “serious”, but must be dropped because Kavanaugh, as a judge of the US Supreme Court, is no longer covered by the judiciary's misconduct rules.

Though the rules say that “a judge remains subject to the act as long as he or she ‘performs judicial duties,’ ” but according to the order, “those judicial duties must still fall within the jurisdiction of the rules, which do not cover the high court”.

The matter was taken care of by 8 judges, and the order was signed by Timothy M. Tymkovich.

The complaints must be dismissed because an intervening event — Justice Kavanaugh’s confirmation to the Supreme Court — has made the complaints no longer appropriate for consideration under the [Judicial Conduct and Disability Act],” judge Tymkovich wrote in the order.
