Delhi High Court refuses to entertain plea on making virtual hearings a norm

NEW DELHI: The High Court of Delhi refused to hear a petition seeking the adoption of virtual hearings in courts as a standard practise in cases where physical presence is not required.

According to a bench consisting of Chief Justice DN Patel and Justice Neena Bansal Krishna, there was no rationale to entertain the public interest litigation at this time because the issue was being looked into by the HC on an administrative level.

Allowing virtual hearings during the normal course of proceedings, according to the petitioner Mujeeb Ur Rehman, would maximise the use of judicial time. He argued that this is not always essential to be physically present for counsel, litigants, or parties, and that court may opt for virtual hearings to avoid unnecessary physical contact with the general public while the Covid-19 pandemic was still ongoing. "Virtual court proceedings are good for the environment because they reduce the use of papers," according to the plea.

On March 2, the high court commenced full-fledged physical operations, with the option to appear via video conferencing link, which had previously been restricted due to the COVID-19 pandemic.
