Delhi HC allows termination of pregnancy of a pregnant rape victim

Medical termination of 22 weeks of pregnancy of a minor girl has been allowed by Delhi High Court after considering the reports of the medical board and also considering psychological complications of the minor girl.

After the commission of rape, the FIR was lodged at the nearest police station under Section 376 of Indian Penal Code, 1860 and Section 6 of Protection of Children from Sexual Offences Act, 2012.

According to the victim, she got the news of her pregnancy at a later stage and by then the victim was at advanced stage of pregnancy, as a result of which, termination of pregnancy was not a way out.

Justice Vibhu Bakhru was hearing the plea and after considering the report of the medical board, he has allowed the petitioner to continue with the termination of the pregnancy.

The Court after having a discussion with the victim was of the view that the victim was facing considerable distress and also mental trauma. The Court was also of the view that if this pregnancy is continued then the victim may face psychological complications.

Hence the Court has directed that the victim must be admitted to Dr Ram Manohar Lohia hospital for the medical termination of the pregnancy.
