Court refuses 1,200-pages charge-sheet against Kanhaiya Kumar and Umar Khalid, criticises Delhi Police.

Delhi’s Patiala House Court criticised Delhi Police for filing the 1,200-page charge-sheet against former JNU students' union (JNUSU) president Kanhaiya Kumar and others in the 2016 sedition case without approval from the Delhi Government.

Metropolitan Magistrate (MM) Deepak Sherawat granted police time till February 6 to obtain necessary authorisation after they told the court they will get the approvals within 10 days.

The charge-sheet was filed by the Delhi Police against the former JNU students Umar Khalid, Kanhaiya Kumar and other students for allegedly shouting anti-India slogans during the event to commemorate the hanging of Parliament-attack mastermind Afzal Guru and connected events of February 2, 2016.

Delhi Police had approached the Government for sanction approval on the same day they filed the charge-sheet.

 

However, the AAP  Government is yet to give its approval for the sanctions.

In fact, on its part the Government has denied getting any file seeking prosecution sanction in any JNU related case.

 

Kanhaiya Kumar was granted interim bill by the Delhi High Court in the matter in March 2016, almost three weeks after being arrested on charges of sedition under Section 124A of the IPC. Soon after, an Additional Sessions Judge granted interim bail to Khalid as well as Bhattacharya in the case.
