Chhattisgarh HC Judge Pritinker Diwaker Transferred to Allahabad HC

Chhattisgarh High Court Judge, Justice Pritinker Diwaker, has been transferred to the Allahabad High Court.

He has to take charge as the Allahabad HC judge before October 4, 2018.

The notification regarding the same was issued by the Central government today:

In exercise of the powers conferred by clause (1) of Article 222 of the Constitution of India, the President, after consultation with the Chief Justice of India, is pleased to transfer Shri Justice Pritinker Diwaker, Judge of the Chhattisgarh High Court, as a Judge of the Allahabad High Court and to direct him to assume charge of his office in the Allahabad High Court on or before 4th October, 2018.”

The recommendation to transfer Justice Diwaker to the Allahabad HC had initially been made in January this year.

But, the Supreme Court Collegium had refused to reconsider the proposal for Justice Diwaker’s transfer, as stated in a Collegium Resolution dated September 7, saying that:

The Collegium does not find any merit in his representation and is, therefore, of the opinion that the request made by Mr. Justice Pritinker Diwaker cannot be acceded to. The Collegium accordingly resolves to reiterate its recommendation dated 10th January, 2018 for his transfer, in the interest of better administration of justice, to the Allahabad High Court.”

The Central government, however, in pursuant to the initial recommendation has issued the notification directing Justice Diwaker to assume charge of his new office at the Allahabad HC on or before October 4 this year.
