Cheating Case: HC stays Criminal proceedings against OYO top management

Punjab and Haryana High Court has stayed a criminal proceeding which was filed by complainant Vikas Gupta against the OYO management. On September 11, 2020, an FIR was filed against OYO Hotels & Homes Private Limited at Dera Bassi Police Station by complainant Vikas Gupta, who is a business man residing at Chandigarh.

While the Court was hearing the plea, the complainant argued that the top management of the OHHPL had twisted out of an arrangement with him unlawfully and with a criminal intention.

OYO founder Ritesh Agarwal and Sandeep Lodha, CEO of OHHPL’s brand, were taken into custody by the police for this particular crime. Although the complainant alleged that fearing losses in Coronavirus, OHHPL had terminated the deal, the accused argued in the Court that there were disagreements with the other party over the appointment of the arbitrator.

In the Court the accused had also argued that this particular crime is not criminal but civil in nature.
