Centre to Clear Justice Joseph’s Name Along With Justices Indira Banerjee and Vineet Saran for Appointment to SC

Just a day after reports said that the Centre is planning to clear the appointment of two HC judges to the apex court, but not that of Justice Joseph, fresh reports (TOI) have surfaced indicating that the Centre may also clear Joseph's name for elevation.

The Centre is learnt to have accepted the Supreme Court’s Collegium decision to elevate the Uttarakhand High Court Chief Justice KM Joseph to the top court along with the recommendation for appointment of Justices Indira Banerjee and Vineet Saran as SC judges, according to sources in the government.

While Justice Indira Banerjee is the Chief Justice of Madras HC, Justice Saran is the CJ of the Orissa HC.

Justice Joseph's name was rejected for the appointment to SC despite being recommended for elevation twice by the Collegium.

The Centre’s objection to elevating Justice Joseph’s name was speculated to be because of the latter’s decision to strike down imposition of President’s rule in the state by the BJP-led NDA government in 2016.

The sources, however, said that there was nothing wrong with Centre’s decision to send back Joseph’s name as the government noted that there were too many senior judges from Kerala and felt there was lack of higher representation from OBCs and Scheduled Castes in the apex court.

By recommending the elevation of Justice Banerjee and Justice Saran along with Justice Joseph, the court appears to have appreciated our viewpoint and we appreciate the collegium’s choice,” a top government functionary was quoted as saying as per reports.
