Bride That Does Not Take the Initiative to Do House Chores Is Not Cruelty: Delhi High Court

New Delhi: A Division Bench of the High Court presided by Justices Hima Kohli and Asha Menon in an appeal against an order passed by a Family Court, held that if a bride does not  show any  interest in doing household chores it can by no means be defined as cruelty towards her husband.
 

The court also said a new bride might hesitate in her new environment, and it is therefore up to the family of her husband to make the new bride feel comfortable and embrace her as a member of the family.

The marriage between the parties took place in November 2012, in accordance with the Hindu rites and ceremonies and no child was born to the parties. The husband claimed that the behavior of the wife had not been positive since the outset of the matrimony and he also alleged that the respondent had a love affair with her brother-in – law.

On this basis, the appellant filed a petition seeking dissolution of marriage under Section 13(1) (i) and (ia) of the Hindu Marriage Act, 1955.

The divorce petition was opposed by the respondent on the ground that the appellant sought to justify his own wrongs on the grounds of cruelty. The respondent also stated that the appellant and his family harassed her for dowry and even attempted to kill her.

The Family Court, however, dismissed the divorce petition filed by the appellant on the basis that he had not provided any proofs of his claim of respondent’s adulterous life.

The bench, however, noted that there was no case of adultery and cruelty against the woman. "In fact, adultery could have been committed only after the marriage between the husband and the wife had been solemnized, and the allegation of adultery on the ground that the respondents had been together before the marriage of the parties is entirely irrelevant," the bench held.

Hence, there was no merit in the present appeal which is, accordingly, dismissed by the Hon'ble High Court of Delhi.
