Biased Judges, Media And Indian Justice System Preventing A Fair Trial, says Mallya’s Lawyers

An expert in Indian law acting as a defence witness in Vijay Mallya's extradition hearing has attacked the integrity of India's criminal justice system, the Supreme Court, as well as the reporting of the beer and airline's case by the Indian media, arguing he will not get a fair trial in India.

Mallya, 61, is fighting extradition to India where he faces charges of fraud and cheating after defaulting on loans to Indian banks worth Rs 9,000cr.

 Dr Martin Lau, professor of South Asian Law at SOAS in London, claimed some Supreme Court judges in India ruled in favour of the government of India to win government posts after retirement; the criminal justice system in India was at times corrupt; and, Mallya was facing trial by media ahead of a trial, meaning he would not get a fair trial in India.  

Referring to an unnamed piece of research, Lau told Westminster Magistrates' Court: "I hold the Supreme Court of India in the highest respect but at times some doubts are voiced about particular patterns. That does not mean it is a corrupt institution. At times it rules in favour of the government, especially when judges are close to retirement and angling for government posts. This suggests government influence over judicial decision making that seriously undermines judicial independence."

Lau added although the Supreme Court is "heavily burdened", the Mallya case went to it with "considerable apace". [Source: TOI]
