BCI Calls for Nationwide Demonstration to Protest against SC’s Strike-Ban on Lawyers

The Bar Council of India (BCI) on Wednesday passed a resolution calling Bar Associations throughout the country to participate in a nationwide demonstration to protest against Supreme Court’s ban on strikes and boycotts by lawyers.

Besides the ban, the resolution has been passed to make a demand from the Union and the State Governments to arrange provisions like insurance, medi-claim, pension, stipend and other welfare measures for lawyers.

The resolution was passed by the BCI following a Joint Meeting with the representatives of all State Bar Councils, representatives of the Delhi HC Bar Association, District Bar Associations of Delhi, and NCR on September 1.

The protest is likely to be held some time in October this year.

The principal agenda for the meeting was to voice protest against the SC ordered ban on strikes and boycotts by lawyers, which the BCI has called as a “direct attack on the fundamental rights of advocates going on strike even against genuine injustice, wrongdoings…”.

And, in order to counter the attack, BCI has directed every Bar Associations of the country to meet on September 17 at their respective headquarters, following which a resolution will be passed by the Council against the top court’s strike-ban.

The Council has further directed that the resolution should be provided to local authorities, including the Member of Parliament, Collectors, District Judges and the State Bar Council.

Further, the BCI has also intimated that two committees would be formed — a 21 member Central Steering Committee and a 15 member State Steering Committee – to organise the nationwide agitation.

The resolution further proposes:

  1. Abolition of Section 34 of the Advocate’s Act, 1961, the provision that empowers the High Court to frame rules to standardize legal practice by advocates.
  2. Withdrawal of the Higher Education Commission Bill.
  3. Leaders of the Bar Councils must be consulted before appointments of judges in all courts of the country.
  4. An Advocates Protection Act must be passed at the Central level, including provisions for the welfare of advocates.
  5. Rs 25 Lakhs must be sanctioned for flood affected lawyers in Kerala.
