APPEALS FILED BY SONIA AND RAHUL GANDHI AGAINST DELHI HIGH COURT'S ORDER OF THEIR 'TAX RE-ASSESSMENT' WILL BE HEARD IN AUGUST: Supreme Court

On January 8, 2019 the Apex Court was informed by the Income Tax department that the Assessment Order with respect to Sonia Gandhi and Rahul Gandhi which was passed for the assessment year 2011-2012 has still not been given any effect. The order related to Herald case.

There are accusations against both the mother-son duo and others among them for entering into conspiracy with the intent to cheat and misappropriate funds by making a payment of only Rs. 50 lakhs. Though the right given to young Indian (YI) to recover was that of Rs 90.25 crore that Associated Journals Ltd (AJL) owed to the Congress party. 
The Gandhis and Oscar Fernandes, a senior Congress leader have put forth a challenge to the Delhi High Court's verdict (September 10) by which their plea against the re-assessment of their tax for 2011-12 was dismissed.

Liberty has been granted to the petitioners by Supreme Court bench comprising of Justices D Y Chandrachud and Hemant Gupta for approaching to the Delhi Income Tax Appellate Tribunal (ITAT) for the purpose of expeditious hearing of pending appeal challenging the retrospective cancellation of registration granted to Young Indian under the I-T Act.

During the hearing on Tuesday, the bench said:

"You have challenged the cancellation of registration before the tribunal. We may have some difficulty if suppose we say that the cancellation was bad. So proper procedure would be to wait for ITAT order. We will then have the benefit of the tribunal's order. If you succeed there, then issue of re-opening goes."
investigation into a private criminal complaint filed by BJP leader Subramanian Swamy before a trial court here in connection with the National Herald case gave rise to the Income Tax probe against the Congress leaders.

The Supreme Court, on Tuesday (April 23) said the appeals filed by Rahul Gandhi and Sonia Gandhi would be heard in August. The matter is tentatively listed the week commencing on August 19.
