Allahabad HC Dismisses Plea Seeking Judicial Probe Into Alleged Encounter Of Kanpur Gangster Vikas Dubey

A Special Investigation Team and Judicial Commission was constituted by U.P. Government to investigate Vikas Dubey’s criminal activities and also the involvement and support of police in the crimes committed by Dubey.

A petition was filed before the Allahabad HC on wanting Judicial investigation into alleged encounter of the said gangster. Although,the apex court has dismissed the petition on Monday.

Justice Pankaj Kumar Jaiswal and Kurnesh Singh Pawar found that there is no need of constituting another Judicial Investigation as previously Special Investigation Team and Judicial Commission had already been constituted by the U.P. Government.

A former Judge of Allahabad High Court Justice Sashi Kant Agarwal is now being appointed by the U.P. Government as a member of Judicial Commission under Section 3 of the Enquiry Commission Act, 1952 for investigating into the said matter within a period of two months.

 The petition was lodged by a practicing Advocate of the High Court, Nandita Bharti, and seeking guidance for the establishment of a Judicial Commission headed by a former HC Judge to investigate the alleged encounter in the light of the guidelines set out by the Supreme Court. 

Recently one of the police officer got arrested as is suspected to have connivance with the gangster. He has moved to the Supreme Court for protection of life from UP Police.

There were many cases registered and were pending against the gangster Vikas Dubey and he was allegedly killed by a police encounter on Friday. The incident has given rise to a major debate on police as well as political interaction with the gangster.
