Actor Rajpal Yadav and wife found guilty in cheque bounce case

New Delhi : Delivering a verdict on complaint filed by Messrs Murli Projects Pvt. Ltd., which had given an inter-corporate loan of  Rs 5 crore to Mr. Yadav for making a film titled ‘Ata Pata Lapata’ in 2010, Additional Chief Metropolitan Magistrate Amit Arora at the Karkardooma courts in Delhi convicted Rajpal Yadav, his wife Radha Rajpal Yadav and their film production company Messrs Naurang Godavari Limited  in a cheque bounce case.

As per the complainant, Mr. Yadav had promised to pay Rs 8 crore back but thrice defaulted in his commitment. Finally actor promised to pay Rs 11.10 crore to settle the loan.But due to some differences on music rights, disputes arose between the two parties following which Murli Projects approached high court seeking stay on the release of film. But Mr.Yadav gave an understanding that the cheque amounting to Rs 7 crore would be honoured. On that basis complainant withdrew the plea and the film was released. When the complainant tried to encash the cheques, the cheques bounced , the reason being insufficient funds.

Mr. Yadav argued in the court that the money received was an investment and not a loan and as the film flopped there was no money to be paid back. He said he is under no obligation to repay. His wife said all the commercial decisions were taken by her husband and she was not aware of the loan.

The court rejected the argument  and convicted all the accused, Messrs Shree Naurang Godavari Entertaiment Limited, Rajpal Navrang Yadav and Radha Rajpal Yadav  under Section 138 of the Negotiable Instruments Act.

The sentencing in the case will happen on April 23.
