6 names recommended for appointment as HC judges comes under government scrutiny

The Government’s insistence on merit being the sole basis of making judicial appointments will be tested again considering that the recommendations made by the Patna HC for HC judgeship are close relatives of a Union Minister and an ex-SC judge.

Some of the government sources have confirmed that the recommendations made by the Patna HC might necessitate closer scrutiny also to verify the dominance of a particular caste.

Only a few weeks ago, the government had expressed reservations about half of the names of the 126 names recommended for appointment as HC judges.

The observations conveyed to the SC Collegium relating to the reservations ranged from failure of the candidates to meet the minimum income requirement to issues regarding integrity and competence. The observations were made by the Intelligence Bureau after carrying out a rigorous background check of advocates and the assessment of the advocates' credentials.

Also, the government has on August 1 given the Collegium proof of nepotism in picks for Allahabad HC. The government has mentioned relationships of at least 11 candidates with sitting and former HC and SC judges among 33 recommendations made by the Allahabad HC Collegium to the SC Collegium.
