“There is not a single ST Judge in Supreme Court”, resulting in bias: BJP MP

According to a TOI report, Chintamani Malviya, Member of Parliament (MP) and Ujjain’s BJP spokesman, has alleged that the Supreme Court delivered the order relaxing the arrest clause in SC/ST (Prevention of Atrocities) Act because the top court consists of judges belonging to general category.

Malviya was referring to the March 20 Supreme Court ruling that issued a slew of guidelines for arrests under the SC/ST Act “to avoid false implications”. The court in its ruling has said that a preliminary inquiry may be conducted by a Deputy Superintendent of Police (DSP) to ascertain allegations against the accused are not “frivolous or motivated” before a case is registered.

You all know why the SC took such a decision. There is not a single judge in the Supreme Court. The appointments are made through a collegium system, where judges choose who will be the next judge, not the government,” Malviya is seen telling his party workers in a viral video.

The video also shows the MP saying, “There are 500 families in the country. The judges are appointed from only these families. Somebody’s grandson, somebody’s brother. All from general category. Why is this happening? Because there is no reservation there.”

The report also mentioned that when contacted the Ujjain’s BJP MP not only stood firm on his comments, but even took it a step further, saying “It is an established fact. What did I say wrong? The decision was wrong. It delayed action against exploiters.”
