“Former CJI Dipak Misra was being remote-controlled from outside”: Justice Kurian Joseph

After demitting office on Thursday, Justice Kurian Joseph, made a stunning claim that he and three other senior-most SC judges had held the unprecedented press conference on January 12, this year as they felt that “the former CJI was being controlled from outside and was allocating cases to judges with political bias”, reports TOI.

In an exclusive interview to TOI, when Justice Joseph was asked what seemed wrong within 4 months of Justice Misra taking over as CJI, he said:

There were several instances of external influences on the working of the Supreme Court relating to allocation of cases to benches headed by select judges and appointment of judges to the Supreme Court and high courts.”

Justice Joseph further added, “Someone from outside was controlling the CJI, that is what we felt. So we met him, asked him, wrote to him to maintain independence and majesty of the Supreme Court. When all attempts failed, we decided to hold a press conference.”

And when Justice Joseph was asked to elaborate on what he meant by “external influence”, the retired SC judge said:

Starkly perceptible signs of influence with regard to allocation of cases to different benches selectively, to select judges who were perceived to be politically biased.”
